AC Wise Terms of Service

These Terms of Service (the “Terms”) apply to your access to and use of the AC Wise website and platform, operated by AC Wise, ABN 47 718 879 496. By using the site or submitting a request through it, you agree to these Terms. If you do not agree, please do not use the platform.

This version takes effect on 10 September 2026 and replaces the previous version dated December 2025. These Terms should be read together with our Privacy Policy and Cookie Policy.

1. Role of AC Wise

AC Wise operates an independent information, lead generation and marketplace platform designed to help property owners make more informed air conditioning decisions and connect with suitable independent air conditioning businesses.

AC Wise may provide:

  • educational information, guides and general guidance;
  • tools and calculators;
  • quote request functionality; and
  • introductions to independent installation partners.

Unless expressly stated otherwise, AC Wise does not itself quote for, sell, design, supply, install, commission, service or warrant air conditioning systems.

2. Independent installation partners

Installation partners participating in the AC Wise platform are independent businesses. They are not employees, agents, representatives, joint venture partners or subcontractors of AC Wise merely because they participate in the platform or receive an introduction or enquiry through it.

Any quotation, recommendation, system design or selection, agreement, product supply, installation, workmanship, commissioning, certification, warranty, maintenance or other service provided by an installation partner is provided independently by that partner. The relevant installation partner is responsible for its own:

  • licences and registrations;
  • insurances;
  • quotations and pricing;
  • system recommendations and design;
  • products supplied;
  • installation and workmanship;
  • employees and subcontractors;
  • certificates and regulatory requirements;
  • warranties and after sales obligations; and
  • compliance with applicable laws, regulations, codes and industry requirements.

3. AC Wise partner verification

AC Wise may establish eligibility and verification requirements for businesses participating in the platform. Where AC Wise states that a partner has been verified, vetted, approved or has satisfied AC Wise participation requirements, that statement refers only to the checks actually undertaken by AC Wise at the relevant time. Verification does not constitute a guarantee by AC Wise of:

  • future conduct;
  • workmanship;
  • the suitability of a particular system;
  • the accuracy of a quotation;
  • availability;
  • pricing;
  • performance;
  • regulatory compliance after verification; or
  • the outcome of services subsequently provided by the partner.

Partners remain responsible for maintaining all required licences, registrations, certifications and insurance while participating in the AC Wise platform.

4. Quote requests and homeowner agreements

Submitting a quote request through AC Wise does not require you to accept a quotation or enter into an agreement with an installation partner. Any quotation provided by an installation partner is subject to that partner’s own assessment, pricing, site requirements and terms.

Where you choose to engage an installation partner, the contract for the relevant installation or other trade services is between you and the installation partner unless expressly stated otherwise. AC Wise is not a party to that installation contract merely because the introduction or quote request originated through the AC Wise platform.

5. Educational information and tools

Information, guides, calculators, estimated costs, system comparisons and other educational material made available through AC Wise are intended to assist you in making informed decisions. They are general information and do not replace an appropriate site assessment or professional advice where one is required.

Actual system requirements, installation requirements, performance and costs can vary according to factors including the property, climate, building construction, existing infrastructure, site conditions, system design, equipment selected and individual installer pricing.

Where AC Wise or its content refers to finance options for an air conditioning purchase, that information is general in nature and is not financial or credit advice. AC Wise is not a credit provider and does not provide financial advice. If you are considering finance, we recommend seeking advice from a licensed financial adviser or credit provider before entering into any finance agreement.

6. No guarantee of third-party services

AC Wise takes reasonable steps to establish participation requirements for installation partners but does not perform or supervise the installation services supplied by those independent businesses. AC Wise does not sell, endorse or warrant any particular product or installation partner.

To the maximum extent permitted by law, AC Wise does not guarantee the workmanship, products, representations, quotations or services supplied independently by an installation partner. Nothing in this section limits any rights you may have directly against an installation partner or a manufacturer, or any consumer guarantee that applies by law.

7. Your responsibilities

When using the AC Wise platform you agree that:

  • the information you submit is accurate and complete;
  • you will use the platform only for lawful purposes; and
  • you will not misuse, interfere with or attempt to gain unauthorised access to the platform or its systems.

8. Intellectual property

All content on the website, including text, logos, graphics, videos and layout, is protected by copyright and other intellectual property laws. You may not reproduce or re-use content without our written permission.

9. Limitation of liability

To the maximum extent permitted by law, AC Wise excludes liability for indirect, incidental, special or consequential loss arising out of or in connection with the use of the AC Wise platform or services independently supplied by third parties, including loss of profit, revenue, business opportunity, anticipated savings or data.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law. Where AC Wise is liable for a failure to comply with a consumer guarantee that cannot be excluded, and the relevant service is not of a kind ordinarily acquired for personal, domestic or household use, AC Wise’s liability is limited, at its option, to resupplying the relevant service or paying the cost of having it resupplied.

10. Third-party platforms and services

AC Wise may use or integrate with third-party technology and service providers for functions including payments, communications, analytics, infrastructure and platform functionality. Where financial transactions are processed through an external payment provider, AC Wise does not intentionally store full payment card information within the AC Wise platform.

The website may also contain links to third-party sites. Third-party services and sites are subject to the terms and privacy practices of the relevant provider, and AC Wise is not responsible for their content, services or policies.

11. Privacy

Our Privacy Policy and Cookie Policy explain how we handle personal information. By using the platform you agree to those policies.

12. Australian Consumer Law

Nothing contained in the AC Wise website, these Terms, our disclaimers or any other terms is intended to exclude, restrict or modify any right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date above. Continued use of the platform after an updated version is posted constitutes acceptance of the change.

14. Governing law

These Terms are governed by the laws of Australia. Any disputes will be handled by Australian courts or other applicable authorities.
